Today’s Action: Equal rights for women under the Constitution
“Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.”
Women’s rights advocates have been fighting to add these words for equal rights protections to our Constitution for nearly 100 years, while right-wing and corporate interests have successfully kept them out.
That lack of protections has taken a toll, wherein determining sex discrimination is left up to the whimsy of the ever-changing Congress, states, and courts, with a variety of regional results.
The Equal Rights Amendment was first introduced in 1923, and only approved by Congress in 1972. But a Constitutional amendment requires state ratification by a three-fourths majority, or 38 states. And on January 20, 2020, Virginia became the 38th state to ratify, thanks to the progressive push which swept the state legislature this past fall!
The final hurdle is an unprecedented deadline to ratify the ERA by 1982. Though some question the deadline’s constitutionality, Congress could simply repeal the deadline and allow the will of the people to prevail and the ERA to sail into the Constitution. Or Congress could do nothing and let the courts decide if the deadline is legal.
The House has passed the repeal of the deadline – and now we move to the uphill battle in the Senate.
Democrats in the Senate need our support to push through the wall of sexism currently blocking the passage. Led by Senate Majority Leader Mitch McConnell (R-KY) and familiar sidekicks like Lindsey Graham (R-SC), the opposition is strong – but strong opposition has never stopped the fight for equality before and it must not stop now.
The ERA is now more in reach than ever before. Once a part of our Constitution, states would be required to address issues like sexual harassment, pregnancy and and motherhood discrimination, and paycheck disparity in a real way….finally.
